Welcome to In and Out Movers. These Terms and Conditions (“Terms”) govern the moving, storage, and relocation services provided by In and Out Movers (“Company”, “We”, “Us”, or “Our”) to the customer (“Customer”, “You”, or “Your”).
By booking a service with us, paying a deposit, or signing a Bill of Lading, you agree to be bound by these Terms.
1. Scope of Services
We provide residential and commercial moving services, including local, long-distance, and international relocation. We also offer packing, unpacking, and storage solutions at our secure facility.
Inclusions: Services include the labor, vehicle, and equipment necessary to transport your household or commercial goods as detailed in your estimate.
Exclusions: Unless specifically agreed upon in writing, we do not disconnect/reconnect gas or water lines, transport hazardous materials, or move items that are structurally unsafe.
2. Estimates and Quotes
Non-Binding Estimates: Unless specifically stated as “Binding,” all quotes provided are non-binding estimates based on the inventory and information provided by the Customer. Final charges are based on the shipment’s actual weight/volume, labor hours, and materials used.
Inventory Accuracy: It is the Customer’s responsibility to ensure the inventory list provided for the quote is accurate. Significant additions to the inventory on moving day may result in price adjustments or the requirement for additional trucks/crew.
3. Booking and Payments
Deposits: A deposit is required to secure your moving date. This deposit is deducted from your final bill.
Payment Methods: We accept [Credit Cards, Cash, Certified Checks, Money Orders]. Personal checks are [Not Accepted] on the day of the move.
Payment Due: Full payment is due upon delivery of goods (for local moves) or prior to unloading (for long-distance moves).
Delinquency: Failure to pay in full may result in the retention of goods. In such cases, storage fees and redelivery charges will apply.
4. Cancellation and Rescheduling
We understand that plans change. However, late cancellations cause scheduling conflicts.
Cancellation Fee: If you cancel your move within [e.g., 48 or 72] hours of the scheduled date, the deposit is non-refundable.
Rescheduling: Rescheduling requests made with less than [e.g., 5] days’ notice may be subject to a rescheduling fee.
5. Liability and Valuation Coverage
In accordance with federal and state regulations, we offer two levels of liability coverage:
Option 1: Released Value Protection (Standard): Provided at no additional cost. Our liability for loss or damage is limited to $0.60 per pound per article. This is minimal protection and typically covers only a fraction of the value of your goods.
Option 2: Full Value Protection (Recommended): For an additional premium, we are liable for the replacement value of lost or damaged items, subject to a deductible.
Exclusions to Liability: We are not liable for:
Items packed by the Customer (“PBO” – Packed by Owner), unless the box is visibly damaged by us.
Damage caused by “Acts of God” (weather, natural disasters).
Internal workings of electronics (unless there is visible external damage).
Prohibited items (e.g., jewelry, cash, medication, hazardous materials).
6. Customer Responsibilities
Presence: You or your authorized representative must be present during the loading and unloading phases to sign paperwork and oversee the process.
Packing: If you are packing yourself, all boxes must be sealed and ready for transport before the crew arrives. Loose items may not be moved.
Access: You must ensure our trucks have legal and safe access to parking. Any parking tickets received while positioned at your instruction are the Customer’s responsibility.
7. Storage Policy
Access: Access to goods stored in our Rockville, MD facility may require an appointment and is subject to warehouse handling fees.
Payment: Storage fees are billed monthly. Failure to pay storage fees for [e.g., 3 months] may result in a lien on the goods and their eventual sale to cover the debt, in accordance with Maryland State Law.
8. Claims
Reporting: Any claim for loss or damage must be filed in writing.
Timeline: For local moves, claims must be filed within [e.g., 30 or 90] days of delivery. For interstate moves, customers have up to 9 months to file a claim under federal law.
Resolution: We reserve the right to inspect damaged items before a settlement is reached. Do not dispose of damaged items until the claim is resolved.
9. International Moves
For international relocations, additional terms apply regarding customs clearance, port fees, and international shipping regulations. The Company is not responsible for delays caused by customs inspections or port strikes.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Rockville, MD.
